1. Fee Policy

a. Participation in any course is deemed acceptance of these Terms. KCLC will accept course enrolments online, during Enrolment Week via the enrolment form or in person at the Centre. Fees for each course will be payable in full at enrolment. Courses, times and fees may change at KCLC discretion.

b. KCLC may issue refunds within 2 weeks of the course starting. After this time no fee refunds will be provided.

2. Participation

a. You (which includes your successors and assigns) assume all of the risks of participating or attending the KCLC courses including without limitation, any risks that may arise from negligence or carelessness on the part of KCLC, the tutors or any KCLC agent or from dangerous or defective equipment controlled or provided by KCLC.

b. You waive, release, and discharge KCLC, the tutors or any KCLC agent from any and all liability, including but not limited to, liability arising from the negligence or fault of KCLC, for your death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to you including my traveling to and from any course or the centre. These releases and waivers will be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

c. You indemnify, hold harmless, and will not sue KCLC, the tutors or any KCLC agent and release them from any and all liabilities or claims made in any way related to your participation in any course, whether caused by negligence or otherwise.

d. You certify that you are reasonably physically fit relative to the course that you have chosen and that there are no health-related reasons or problems which preclude your participation in such course.

e. You acknowledge that all information provided to KCLC is correct, complete and not misleading in any way.

f. You understand that you may be photographed at any time and authorise KCLC to use your photo or video for any reasonable purpose.

g. You agree to comply at all times with the KCLC Constitution and By-Laws 2023 and as amended from time to time, including in relation to any issues or complaints that you may have.

3. Privacy

a. KCLC may collect your personal and confidential information required to manage and process your registration and course participation. None of this information will be released outside KCLC, except where you consent in writing or required by law and where it needs to be shared with tutors for the provision of courses. KCLC abide by the principles of the Privacy Act 1988.
